OVERVIEW
Welcome to Fessman MFG. The terms “we,” “us,” and “our” refer to Fessman LLC, doing business as Fessman MFG. Fessman MFG operates this store and website, including its related information, content, features, tools, products, and services (collectively, the “Services”).
Our store is powered by Shopify, which enables us to provide the Services.
These Terms of Service, together with any policies referenced within them, describe your rights and responsibilities when accessing or using the Services.
Please read these Terms carefully. They contain important information concerning your legal rights, including warranty disclaimers and limitations of liability.

SECTION 1 – ACCESS AND ACCOUNTS
By agreeing to these Terms, you represent that you have reached the age of majority in your state of residence or have permission from a parent or legal guardian to use the Services.
You may be asked to provide information such as your name, email address, billing information, payment information, and shipping address. You represent that all information you provide is accurate, current, and complete and that you have the right to provide it.
You are responsible for protecting your account credentials and for all activity performed through your account. You may not transfer, sell, assign, or license your account to another person.
SECTION 2 – PRODUCTS AND PRODUCT INFORMATION
We make reasonable efforts to accurately describe and display our products. However, colors, finishes, textures, dimensions, and other visual characteristics may appear differently depending on your screen, lighting, photography, manufacturing process, or device settings.
Minor variations may occur in fabricated, machined, welded, cast, coated, painted, or 3D-printed products. These variations do not necessarily constitute a defect when they do not materially affect the product’s intended use.
Product measurements and specifications should be reviewed carefully before ordering. Customers are responsible for confirming compatibility, dimensions, application, and suitability unless a product listing expressly states otherwise.
Product descriptions, specifications, prices, and availability may be updated without notice. We reserve the right to discontinue products or limit quantities offered to any person, geographic region, or jurisdiction.
SECTION 3 – ORDERS
Submitting an order constitutes an offer to purchase. Fessman MFG may accept, decline, modify, or cancel an order when reasonably necessary, including because of product availability, pricing errors, suspected fraud, payment problems, shipping restrictions, or incorrect product information.
An order is not accepted until payment has been processed and we provide confirmation of acceptance or begin fulfilling the order.
Please review your order carefully before submitting it. We may be unable to cancel or modify an order after fabrication, machining, printing, assembly, or shipment has begun.
If we decline, modify, or cancel an order, we will attempt to notify you using the email address, billing address, shipping address, or telephone number supplied with the order.

Products may not be purchased for unauthorized resale, unlawful export, or any prohibited purpose.
SECTION 4 – CUSTOM AND MADE-TO-ORDER PRODUCTS
Custom, personalized, modified, specially fabricated, or made-to-order products may be manufactured according to information, measurements, drawings, models, specifications, or approvals supplied by the customer.
The customer is responsible for confirming that all submitted dimensions, specifications, drawings, and other information are complete and accurate before production begins.
Unless caused by our failure to manufacture the product according to the approved specifications, custom and made-to-order products cannot be canceled, returned, exchanged, or refunded after production begins.
Changes requested after production begins may result in additional charges and extended completion times. We will obtain approval before proceeding with work that creates a material additional charge.
SECTION 5 – PRICES, BILLING, AND PAYMENT
Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is submitted, subject to correction of obvious errors.
Unless expressly stated otherwise, displayed prices do not include applicable taxes, shipping, handling, or other charges. These charges will be displayed during checkout when applicable.
Prices offered through our website may differ from prices offered through physical locations, custom estimates, wholesale arrangements, or third-party sales channels.
You agree to provide accurate and complete purchase, payment, billing, and account information. You authorize us and our payment providers to charge your selected payment method for the full amount of your order.
You represent that you are authorized to use the payment method submitted and that the information provided is accurate.
SECTION 6 – SHIPPING AND DELIVERY
Fessman MFG currently ships only within the contiguous 48 United States. We do not ship internationally or to Alaska, Hawaii, United States territories, or APO/FPO addresses unless we expressly agree otherwise in writing.
Processing, production, and delivery dates are estimates and are not guaranteed unless expressly confirmed by us in writing.
Custom fabrication, machining, assembly, coating, or 3D-printing may require additional production time. Estimated production times may change because of material availability, equipment issues, supplier delays, order changes, shipping-carrier delays, severe weather, or events outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address. Additional shipping charges resulting from an incorrect or incomplete address may be charged to the customer.
Please inspect shipments promptly upon delivery. Retain all packaging and contact us at fessmanmfg@gmail.com if a package or product arrives damaged.

SECTION 7 – DIGITAL PRODUCTS AND LICENSES
Digital products may include CAD files, 3D models, STL files, drawings, plans, templates, instructions, documents, and other downloadable material.
All digital products are licensed, not sold. Purchasing a digital product grants only the original purchaser a limited, non-exclusive, non-transferable, and revocable license to use the file for personal, non-commercial purposes.
Unless a product listing expressly grants a separate commercial license, you may not:
(a) sell, resell, share, gift, sublicense, distribute, publish, upload, transfer, or otherwise provide the digital file to another person or business;
(b) sell, share, or distribute a modified, converted, remixed, traced, reverse-engineered, or derivative version of the digital file;
(c) upload the file or any modified version to a file-sharing service, marketplace, social-media platform, cloud library, repository, or other distribution platform;
(d) use the file to manufacture, print, machine, fabricate, or produce physical products for sale, resale, or other commercial purposes;
(e) use the file as part of another product, design package, subscription, course, collection, or digital download offered for sale or distribution; or
(f) claim ownership or authorship of the file or its underlying design.
You may create physical items from the file only for your own personal, non-commercial use, unless the applicable product listing expressly grants commercial manufacturing rights in writing.
Purchasing or downloading a digital product does not transfer any copyright, patent, trademark, design right, trade secret, or other intellectual-property right. All rights not expressly granted remain the property of Fessman MFG and its licensors.
Digital products are considered delivered when the download link or file becomes available. Because digital products cannot be physically returned, digital purchases are non-returnable and non-refundable after delivery or access, except where required by law or when the delivered file is materially defective or different from the product purchased.
The purchaser is responsible for determining whether a digital file is compatible with their equipment, software, materials, skill level, and intended application. We do not guarantee identical results across different machines, printers, manufacturing processes, software platforms, materials, or operating systems.
Any use outside this license requires prior written permission from Fessman MFG. Commercial licenses, when available, must be purchased separately and are governed by the terms stated in the applicable product listing or written license agreement.
SECTION 8 – PRODUCT USE AND SAFETY
Customers are responsible for selecting, installing, operating, maintaining, and using products safely and appropriately.
Installation, machining, fabrication, welding, electrical work, mechanical work, vehicle modification, and operation of machinery can involve serious risks. Products should be installed and used only by individuals with the necessary experience, equipment, training, and protective gear.
Customers are responsible for inspecting products before use and confirming that each product is appropriate for its intended application.
Unless expressly stated otherwise, our products are not designed or certified for aviation, medical, emergency, life-support, nuclear, or other safety-critical applications.
Do not use a product if it appears damaged, improperly fitted, incorrectly installed, or unsuitable for the intended application.
SECTION 9 – INTELLECTUAL PROPERTY
The Services and their contents—including trademarks, business names, text, photographs, graphics, product designs, videos, audio, downloads, and the arrangement of this material—are owned by Fessman MFG, its affiliates, or its licensors and are protected by applicable intellectual-property laws.
Except for rights expressly granted under a purchased digital-product license, these Terms permit you to use the Services for lawful personal purposes only.
You may not reproduce, distribute, modify, publicly display, publicly perform, republish, download, store, sell, or transmit material from the Services without our prior written permission.
Nothing in these Terms grants a license to use any patent, trademark, copyright, design, trade secret, or other intellectual property belonging to Fessman MFG, Shopify, or another party except as expressly stated.
The names Fessman MFG and Fessman LLC, together with our logos, product names, designs, and slogans, are trademarks or trade names of their respective owners. They may not be used without permission.
SECTION 10 – OPTIONAL THIRD-PARTY TOOLS
We may provide access to tools, applications, integrations, or services operated by third parties. We do not necessarily monitor, control, or endorse these third-party services.
Access to third-party tools is provided “as is” and “as available” without warranties or representations from us.
Your use of optional third-party tools is at your own discretion and risk. You are responsible for reviewing and accepting the terms and privacy policies applicable to those tools.
New features, tools, and resources added to the Services may also be governed by these Terms.
SECTION 11 – THIRD-PARTY LINKS
The Services may contain links to websites, products, content, or services operated by third parties.
We are not responsible for examining or verifying the accuracy, content, security, or practices of third-party websites. Accessing a third-party website is at your own risk.
We are not liable for harm or damages connected with your use or purchase of third-party products, services, resources, or content.
Review the applicable third party’s policies before completing a transaction. Questions or complaints concerning third-party products and services should be directed to the third party.
SECTION 12 – RELATIONSHIP WITH SHOPIFY
Fessman MFG is powered by Shopify, which enables us to provide the Services.
However, purchases made from our store are transactions directly between you and Fessman MFG. Shopify is not responsible for any aspect of a sale between you and Fessman MFG, including any injury, damage, or loss resulting from a purchased product or service.
To the extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions made with Fessman MFG.

SECTION 14 – FEEDBACK AND REVIEWS
If you submit, upload, post, email, or otherwise provide ideas, suggestions, reviews, photographs, feedback, proposals, or other content (“Feedback”), you grant us a worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, distribute, and display that Feedback for operating, improving, and promoting the Services.
You represent that you own or have the necessary rights to the Feedback and that it does not violate another party’s copyright, trademark, privacy, publicity, or other rights.
You must disclose any payment, discount, free product, or other incentive received in connection with submitted Feedback.
We are not obligated to keep Feedback confidential, compensate you for Feedback, or respond to Feedback.
We may monitor, edit, decline, or remove Feedback that we reasonably determine is unlawful, abusive, misleading, defamatory, obscene, infringing, or otherwise inappropriate.
You may not use a false identity or misrepresent the origin of Feedback.
SECTION 15 – ERRORS, INACCURACIES, AND OMISSIONS
Information provided through the Services may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, pricing, promotions, shipping charges, availability, specifications, or delivery estimates.
We reserve the right to correct errors, update information, or cancel affected orders when information is inaccurate, including after an order has been submitted. If we cancel a paid order, we will issue an appropriate refund.
SECTION 16 – PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services:
(a) for an unlawful, fraudulent, or malicious purpose;
(b) to violate federal, state, or local laws or regulations;
(c) to infringe our intellectual-property rights or the rights of another party;

(f) to upload or distribute viruses, malware, or harmful code;

We may suspend or terminate access to the Services if we reasonably determine that these Terms have been violated.
SECTION 17 – AUTOMATED SYSTEMS AND AGENTS
Automated tools, bots, agents, scrapers, and similar systems may not access, interact with, or extract information from the Services in a way that violates applicable law, bypasses security measures, disrupts the Services, conceals the system’s automated identity, or conflicts with instructions provided through our website.
This restriction does not prohibit ordinary search-engine indexing or automated services that we have authorized.
We may use reasonable technical measures to limit or control automated access to the Services.
SECTION 18 – TERMINATION
We may suspend or terminate your account or access to the Services if you violate these Terms, misuse the Services, engage in suspected fraudulent activity, or create a risk of harm to us, Shopify, another user, or a third party.
You remain responsible for amounts properly owed through the effective date of termination.
Provisions concerning intellectual property, digital-product licenses, feedback, warranty disclaimers, limitations of liability, indemnification, governing law, and other provisions that by their nature should survive will remain effective after termination.
SECTION 19 – DISCLAIMER OF WARRANTIES
The information available through the Services is provided for general informational purposes. We do not guarantee that all information will always be accurate, complete, current, or suitable for every intended application.
Except for warranties expressly provided by Fessman MFG and to the fullest extent permitted by law, the Services and products offered through them are provided “as is” and “as available,” without representations, warranties, or conditions of any kind, whether express or implied.
This includes implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement to the extent those warranties may legally be disclaimed.
We do not guarantee that the Services will always be uninterrupted, timely, secure, or error-free.
Some states do not permit certain warranty exclusions, so portions of this section may not apply to you.
Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
SECTION 20 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, Fessman MFG and its owners, members, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or connected with the Services or a purchased product.
This includes lost profits, lost revenue, lost savings, business interruption, loss of data, replacement costs, or similar damages, regardless of the legal theory asserted and even if advised that such damages were possible.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.
SECTION 21 – INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Fessman MFG, Shopify, and their respective affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from third-party claims, damages, losses, liabilities, and reasonable legal expenses arising from:
(a) your material breach of these Terms;
(b) your unlawful use of the Services;
(c) your violation of another party’s rights; or
(d) your unauthorized modification, installation, resale, redistribution, or misuse of a product or digital file.
We will provide reasonable notice of an indemnifiable claim. You agree to reasonably cooperate with the defense of the claim.
SECTION 22 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law.
Any unenforceable portion will be severed without affecting the validity and enforceability of the remaining provisions.
SECTION 23 – WAIVER AND ENTIRE AGREEMENT
Our failure to exercise or enforce a provision of these Terms does not waive that provision or any related right.
These Terms and the policies referenced within them constitute the entire agreement concerning your use of the Services and supersede prior agreements or communications concerning that use.
Any ambiguity in these Terms will not automatically be interpreted against the party that drafted them.
SECTION 24 – ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights and obligations in connection with a sale, reorganization, transfer of assets, or other lawful business transaction, subject to applicable law.
SECTION 25 – GOVERNING LAW
These Terms and any separate agreements through which we provide the Services are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
Any legal proceeding shall be brought in a court of competent jurisdiction in Virginia unless applicable law requires otherwise.

We may update these Terms by posting a revised version to our website. Material changes will become effective on the date stated in the notice or as otherwise permitted by applicable law.
